The Supreme Court Brexit plan: The EU settlement scheme

 

The EU settlement scheme means that EU citizens with pre-settled status must reapply after five years or risk losing their right to live, work, receive healthcare and education and apply for housing. And there are benefits.
The High Court has ruled that the Brexit plan, which would force EU citizens to reapply for the right to live in the UK, is illegal.

The EU settlement scheme

The Supreme Court is the highest judicial body in Britain. It is the final court of appeal for all UK civil cases and criminal cases from England, Wales, and Northern Ireland, focusing on cases of political and constitutional importance.

The supreme court currently has 11 justices selected by an independent commission and must have either been a High Court judge for two years or a practicing lawyer for 15 years.

The EU settlement scheme is a scheme in which the UK permits European Union citizens to get permission to stay in the UK and live there.

Jun 30 2021, was the settlement time for some European applicants. However, this date may be different for other European applicants.

But Irish citizens don’t need permission because some agreements are related to the previous times.

Indeed, the European Union settlement plan is a short applicant online form that proves the European citizens’ identity and nationality.

According to this form, European citizens must confirm their identity and nationality to remain in the UK and take advantage of its facilities.

After European citizens fill in this application form, the UK government confirms whether or not the European citizens can stay in the UK.

The settlement statute wants European citizens to state that they started their resident status in the UK by Dec 31 2020.

People who are under 21 and want to stay in the UK with their parents don’t need the settlement status, providing that their parents have sufficient conditions for staying in the UK.

Brexit Scheme and European people’s life right in the UK

European people who have moved to the UK before Jan 1 2021, can live in the UK and work there now.

There are new Brexit Schemes for European citizens who have moved to the UK after Jan 1 2021.Indeed, European people who come to the UK after Jan 1, 2021, have to accept new citizenship rules to have an appropriate life in the UK and accept new Brexit schemes.

So the Brexit schemes don’t involve European people who came to the UK on Jan 1, 2021.

The UK has legislated some special situations for European citizens who have been living in the UK for more than five years.

They can have a life right in the UK; they can work and be retired there and receive a pension from the UK government.

But European people who have recently moved to the UK after Jan 1 2021, can’t use the benefits of UK citizenship.

They must stay and live in the UK; then they will benefit from living in the UK. So after five years, they can use the benefits of living in the UK.

So European citizens living in the UK for more than five years will be allowed to stay indefinitely by getting ‘settled status’.

It means these citizens will be free to reside in any capacity, access public funds and services and apply for British citizenship.

And this is a Brexit Scheme for them that doesn’t let European people use their life right in the UK.

According to the Brexit scheme, European citizens must obey some special rules to live in the UK and benefit from being UK citizens.

The first one is that European people who want to live in the UK must learn the English language.

So European people who come to the UK for less than five years cannot have a job or life there.

And this is a very hard regulation for the European people who want to stay there for less than five years, and they go to the UK for a special meeting or other reasons.

European families’ life situation in the UK

Indeed, all EU citizens and their families in the UK will need to apply to the Home Office for permission to stay.

Regardless of their arrival date, it will be legally required and will enable these citizens to demonstrate that they have permission to continue to live and work legally in the UK.

However, there will be a grace period of up to two years to give EU citizens and their families sufficient time to make their application.

The settlement time for European citizens

Indeed, European Union citizens can ask for European Union settlement. They can request for European Union settlement up to Jun 30.

From June 30, 2021, there are 28-day announcements for European Union citizens who want to stay in the UK. So the custom and Jersey officials who have yet to ask for the settlement plan from the European Union will face lots of problems.

So in 28 days, the European Union officials must have applied for the settlement form. And people who still need to receive the application form will be included in the UK.

If you were living in Jersey before Jan 1, 2021, but were absent from Jersey on Dec 31 2020, your eligibility for the scheme will depend on how long you were here and how long you were absent.

European Union citizens who want a residence in Jersey must have more continuous years living there and not living there for five years. So if the European Union citizens have yet to receive settlement apply up to Jun 30 2021, they can’t stay in the European Union, and the UK will remove them.

Indeed, the EU settlement scheme is related to Mar 30 2019. At that time, European citizens wanted to stay in the UK after Brexit on Dec 31, 2021 and asked for their residence until June 2021.

According to this scheme, the European citizens of the UK could use life facilities in the UK, providing that they had a settlement status. Otherwise, they couldn’t take advantage of using hygienic services, studying, and having a good job in the UK.

They could use all these facilities, provided they had a settlement status in the UK.
